TiVo $103mn Richer Dish $103mn Poorer

One mans loss is another mans gain they say. Guess it goes much to same for companies too. Tivo, reeling under a loss of subscribers finds good fortune at its door with the court ordering Echostar communications to pay TiVo $103 mn in a long standing patent dispute. In addition Echostar has been ordered to disable infringing features which are present in the DVR’s of its subscribers.In addition Echostar has also been found in contempt of court. They earned this because they violated a permanent injunction – they reprogrammed millions of DVR’s with a new workaround. Due to this contempt substantial harm has been caused to TiVo according to Folsom. Millions of customers were acquired by Echostar who are now potentially out of TiVo’s reach according to the U.S. District Judge.Dish is based in Englewood, Colo. They said an appeal would be made against the contempt ruling and a motion would be filed to stay an order requiring the disabling of the disputed DVR features. According to the company, the engineers of Echostar spent about a year designing around TiVo’s patent and also removing the features that TiVo says infringed at the Trial.Due to this judgement, TiVo rose 36 percent in after hours trading and Dish fell 6.9 percent.
